Location: The company is based at Korporaalweg 10, Willemstad, Curaçao.
1.2 Licensing: Stake is licensed and regulated by the Government of Curaçao, under the gaming license number 8048/JAZ, which is issued to Antillephone, a licensing body.
1.3 Subsidiary Involvement: The document also mentions that some credit card payment processing tasks are managed by Medium Rare Limited, a wholly owned subsidiary of Medium Rare, N.V.

3.1 By signing up at www.stake.com, you (referred to as “You”, “Your”, “Yourself”, or “the Player”) establish a contractual relationship with Stake.

3.3 These Terms and Conditions become effective immediately upon completion of the registration process, which involves agreeing to these Terms and Conditions and successfully setting up an account. Once you use any part of the Website after creating your account, you are confirming your acceptance of these Terms and Conditions.
3.4 We reserve the right to modify these Terms and Conditions at any time without prior notice. 4. STAKE ACCOUNT
Registration
4.1 To place bets on stake.com, you must personally register for an account with us (“Stake Account”).
4.2 To be registered as a player on Stake and utilize the Website, you must personally apply for registration and to open a Stake account. This application must include providing personal details such as email, full name, date of birth, address, etc.
4.3 If the information required in 4.2 is not supplied, or is incomplete, inaccurate, or outdated at any time, Stake reserves the right to halt the registration process of the Stake Account. Furthermore, Stake may consider any deposits made during this period as invalid (and nullify any winnings derived from such deposits). 4.4 All applicants must be at least 18 years old or meet the legal age of majority as prescribed by the laws applicable to them, whichever is higher. Stake may request proof of age from any player and may suspend their Stake Account until such proof is received. Stake is committed to preventing underage and irresponsible gambling.
4.5 Stake will not register individuals who are:

Know Your Customer
4.7 You declare and guarantee that all information you provide on your application form is accurate, current, and truthful.
4.8 Stake may request any KYC (Know Your Customer) documents it considers necessary at any time to verify a Player’s identity and location. Stake may limit the use of the Service, including payments and withdrawals, until it verifies the identity or for other reasons at its sole discretion. Multiple Accounts
4.9 Each Player is permitted only one Stake Account. If you attempt to open more than one Stake Account, whether under your name or another, or use someone else’s Stake Account, Stake can immediately close all associated Accounts, retain all funds in those Accounts, and prohibit you from future use of the Website.
4.10 If Stake believes you have created or used multiple Stake Accounts, or collaborated with others to use several Accounts, Stake may treat those as multiple accounts, and suspend or close them. Stake can also retain any funds until it is proven that there was no intent to create multiple accounts.
4.11 If you discover you have more than one registered Stake Account, you must notify us immediately. Not doing so may lead to your account being blocked and any funds being held.
User Responsibility
4.12 You are solely responsible for keeping your login details secure and confidential. You should not share these details with anyone.
4.13 We are not responsible for any misuse of your Stake Account by others resulting from your sharing of your login details, whether deliberately or accidentally.
4.14 You are not allowed to sell, transfer, or acquire Stake Accounts from or to other players.
4.15 If you notice any errors related to your account or any bet calculations, you must inform us immediately. We reserve the right to declare any bets affected by such errors as void.
4.16 You are responsible for all activities conducted through your account.
Security Features
4.17 We advise you to activate two-factor authentication to better secure your account.
4.18 We may introduce additional security measures periodically and encourage you to utilize these enhancements.
Suspension and Closure by Stake
4.19 Stake has the right to suspend or close your Stake Account if:
- Stake suspects that you have engaged in fraudulent, collusive, illegal, unlawful, or improper activities through the Website;
- Stake believes you have unfairly manipulated the Website, cheated, exploited other customers, or used your Stake Account for someone else’s benefit;
- Stake is required to do so by law enforcement, regulatory authorities, courts, or if your identity, profession, or source of funds cannot be confirmed as required by law;
- You violate these Terms and Conditions, applicable laws, or misuse our services, or if Stake suspects you are gambling compulsively without self-exclusion;
- Stake believes any of the situations mentioned in (a) to (d) might have occurred or are likely to occur.
4.20 If your Stake Account is closed or suspended based on the reasons stated in 4.19, you may be held liable, to the extent permitted by law, for any resulting claims, losses, liabilities, damages, costs, and expenses incurred by Stake, and you agree to indemnify and hold Stake harmless for such claims.
4.21 In such cases, Stake also has the right to void any of your bets, or to withhold and retain any funds due to you, including winnings, as allowed by law.
4.22 We may suspend or terminate your account at any time, with or without notice, if we suspect that your account has been compromised or is being misused in violation of our Terms of Service.
4.23 If Stake closes your Stake Account, we will inform you about the methods available for withdrawing any remaining balance.
Our Liability
4.24 We are not responsible for any losses or damages incurred due to unauthorized access to your account.
4.25 We are not liable for any losses or damages that result from your failure to maintain the security and confidentiality of your login information.
5. YOUR WARRANTIES
5.1 Before and while using the Service, you confirm, guarantee, pledge, and agree that:
Capacity
a) You are either over 18 years old or meet the legal age of majority as specified by laws applicable to you, whichever is older;
b) You possess the full legal capacity to enter into binding contracts and are not under any legal restrictions;
c) You have not been identified as a compulsive or problem gambler;
d) You are not currently self-excluded from any gambling platform or venue, and you will notify Stake immediately if you enter into a self-exclusion agreement with any gambling provider.
Jurisdiction
e) You are accessing stake.com from a jurisdiction where it is lawful;
f) You will refrain from using our services in any jurisdiction where online betting, casino games, or live games are illegal;
g) You acknowledge our right to detect and prevent any prohibited activities, which may include checking device attributes, geo-location and IP masking, as well as analyzing transactions and blockchain activities;
Funds & Tax
h) You are responsible for declaring and paying any taxes on winnings as required by relevant laws;
i) You are solely responsible for any taxes due on cryptocurrencies and FIAT currencies received through the Service;
j) You acknowledge the risk of losing cryptocurrencies and FIAT currencies while using the Service, and agree that Stake is not liable for such losses;
k) You will not deposit funds derived from criminal or unauthorized activities;
l) You will only use payment methods registered in your name for deposits;
m) All funds you deposit will be used solely for engaging with services on the Website;
n) You will not attempt to withdraw funds to payment methods that are not in your name;
o) You understand the risk of financial loss involved in participating in the Services offered on the Website;
p) You recognize that the value of cryptocurrencies can fluctuate significantly;
q) Stake is not to be considered a financial institution.
Others
r) You choose to use the Service entirely at your own discretion and risk;
s) You will not use your Stake Account for any illegal activities;
t) You affirm that all information you provide us during this agreement remains accurate, complete, and correct, and you will promptly inform us of any changes to this information;
u) You engage in the Games solely for personal, recreational, and entertainment reasons, not as a professional activity;
v) You engage in the Games personally and not on behalf of anyone else;
w) You maintain only one account with us and acknowledge not opening additional accounts;
x) The telecommunications networks and Internet access services you use to access the Service are outside of Stake’s control, and Stake will not be responsible for any disruptions or performance issues with these services;
y) You will refrain from engaging in any fraudulent, collusive, or unlawful activities in connection with your or others’ participation in any games or services on the Website and will not use any software or devices that assist in such activities;
z) If privy to confidential information that could affect the outcome of an event or betting, you will abstain from betting on such events under the governance of the relevant sports body;
aa) If you are an athlete, coach, manager, owner, or referee, or if you possess sufficient authority to influence the outcome of an event, you will not bet on any event governed by the relevant sport or event body;
bb) If you are an owner (holding 10 percent or greater, directly or indirectly) of a sport governing body or member team, you are prohibited from betting on events managed by that body or involving its member teams;
cc) If involved in a sport or event, you will not participate in setting betting odds for that competition.
5.2 Should you violate any of the above warranties, representations, or agreements, Stake reserves the right, at its discretion, to close or suspend your Stake account and void any related bets, as permitted by law.
6. STAKE WARRANTIES
6.1 Stake guarantees that they will:
a) Handle players’ funds securely and responsibly;
b) Manage personal information about players in compliance with applicable laws and its Privacy Policy.
6.2 The software is provided “as is” with no warranties, whether expressed, implied, statutory, or otherwise. Stake expressly disclaims all implied warranties, including any related to merchantability, quality, suitability for a specific purpose, or non-infringement of intellectual property. Stake does not guarantee that: (i) the Website and Services will fulfill your needs; (ii) the Website and Services will not violate the intellectual property rights of others; (iii) the Website and Services will operate without errors or interruptions; (iv) any faults in the Website and Services will be corrected; or (v) the Website and its servers are free from viruses.

Should Stake determine, at its sole discretion, that your interactions through live chat, email, or any other means are abusive or derogatory towards the employees of Stake or its affiliates or third-party service providers, Stake reserves the right to block or terminate your Stake Account.
7. DEPOSITS
7.1 You may only participate in any Game if your Stake Account has adequate funds. To top up your account, you must use the available payment methods on the Website. Stake will not extend any form of credit for game participation.
7.2 You should fund your Stake Account using the payment methods provided at www.stake.com.
7.3 Ensure that the funds you deposit are free from illegality, specifically that they do not derive from any illegal activity or source.
7.4 To add funds to your Stake Account, you can transfer money from crypto-wallets under your control or use other payment methods listed on stake.com. You must only use your own funds for deposits.
7.5 Deposit money into your account only with the intention of using it to place bets or wagers on the Website. If it is reasonably believed that you are depositing funds without the intention to place bets, Stake has the right to suspend or close your account and may report such activities to the appropriate authorities.
7.6 Acknowledge and accept that all funds for your Stake Account must come from payment methods that are registered in your name.
7.7 Understand and agree that if Stake finds that you have:
a) Used a third party’s payment method for funding your Stake Account; or
b) Deposited funds sourced from illegal activities, such actions will be considered a breach of the Terms of Service and fraudulent, leading to:
i) The potential suspension or closure of your Stake Account at Stake’s discretion; and
ii) The right for Stake to cancel, reverse, or modify any transactions and to seize any deposited funds and/or any winnings derived from them.
7.8 Stake may set and modify the minimum deposit amount at its discretion, and this amount will be displayed on the website. Be aware that additional fees may be charged by your payment provider, depending on the method used.

7.10 Deposits are processed immediately, and your Stake Account balance is updated instantly when using a payment service provider. Stake is not responsible for any delays caused by the payment system or third parties. Note that:

7.14 If a player tries to deposit funds into a blocked or suspended account, Stake has the right to retain those funds.
8. WITHDRAWALS
8.1 Stake reserves the right to refuse any withdrawal from a Player’s Stake Account unless:
a) The Player’s identity is verified, ensuring the withdrawal is authorized by the Stake Account holder;
b) The withdrawal is being made to an account legally owned by the Player;
c) All additional information requested by Stake has been provided;
d) The Player has met the minimum wager requirement for each deposit.
8.2 Stake retains the authority to examine your account and gaming activities. If there is reasonable suspicion of a violation of these terms of service or applicable laws, Stake may delay or decline further deposits, withdrawals, and/or gameplay during its investigation, without an obligation to disclose the investigation’s details.
8.3 Withdrawals must be processed through the same payment method used for deposits, unless it is impractical or Stake decides otherwise. If multiple payment methods were used, Stake may distribute the withdrawal across these methods in compliance with anti-money laundering regulations.
8.4 In the event of an erroneous credit to your Stake Account due to technical or human error, such funds remain the property of Stake and will be deducted from your account. If such funds are withdrawn before the error is identified, the withdrawn amount becomes a debt you owe to Stake. Immediate notification to Stake via email is required upon noticing incorrect crediting.
FIAT Withdrawals
8.5 To request a FIAT withdrawal, you must have wagered 100% of your deposit value.
8.6 Withdrawals from a Stake Account will be made to the Player or a bank account in the Player’s name, subject to enhanced due diligence by Stake if necessary.
8.7 The minimum withdrawal amount is specified on the website during the withdrawal process.
8.8 If multiple withdrawal requests are pending, Stake may consolidate them into a single transaction.
8.9 Stake does not charge fees on withdrawals, but you should verify if your payment method incurs additional charges, for which Stake is not responsible.
Crypto Withdrawals
8.10 Crypto withdrawals are processed to the cryptocurrency wallet address specified in your valid withdrawal request.
8.11 Stake may conduct additional KYC verification for any withdrawal. Players seeking to recover funds from a closed, locked, or excluded account should contact [email protected].
8.12 All transactions are monitored to prevent money laundering. Any suspicious activity related to the games must be reported to Stake immediately. Stake may suspend, block, or close a Stake Account and withhold funds as required by the Prevention of Money Laundering Act or any other legal directive.
9. PLAYER FUNDS PROTECTION & CHARGEBACKS
9.1 The funds you deposit into your Stake Account, as well as any winnings, are held in dedicated customer bank accounts or crypto wallets. These funds are reserved exclusively for placing sports and gaming wagers and for covering any fees or charges associated with the use of our services. This arrangement ensures your funds are not used for any purposes other than those you have authorized.
9.2 Should there be any charge-backs, payment reversals, or denials, or any losses suffered by Stake due to actions linked to your account, we reserve the right to recover such amounts from you.
9.3 We may use any positive balance in your account to offset any amounts you owe to Stake at any time.
10. PLACING BETS/WAGERS
10.1 You are permitted to place bets/wagers on the markets/products available on the Website. Stake is not required to accept any bet/wager, and a bet/wager is only considered valid and accepted once you receive confirmation from Stake.
10.2 Stake accepts bets/wagers only when placed online, including via mobile devices. Bets/wagers submitted through other means (post, email, fax, etc.) are considered invalid and will be void regardless of the outcome.
10.3 It is your responsibility to verify the accuracy of your bet/wager details. Once placed, bets/wagers cannot be canceled by you. Modifications are only possible through the Edit Bet feature, where available. Stake may cancel or amend a bet/wager under circumstances such as event suspension or cancellation, evident mistakes in the bets or odds, breach of terms, or for legal or regulatory reasons.
10.4 Funds are committed to bets/wagers in the order they are received and will not be available for other uses. Stake retains the right to void or reverse transactions involving these funds both at the time of the bet/wager and retrospectively.
11. BET/WAGER CONFIRMATION
11.1 A bet/wager is only valid upon receiving Stake’s confirmation of acceptance. Bets/wagers placed with insufficient funds will be void.
11.2 A bet/wager that you place will only become valid once accepted by Stake and will be acknowledged with a unique transaction code. We are not responsible for settling any bets/wagers that do not receive such a code. 11.3 In the event of a dispute concerning a bet’s details, the Stake transaction log database from our internal control system will serve as the final authority in resolving the issue.

Bonus T&C
12.3 All promotions, bonuses, or special offers must adhere to specific terms outlined for each bonus on the Website(s) and any related promotion-specific terms and conditions. By accepting any promotion, bonus, or special offer, you agree to the respective terms and conditions, acknowledging that cash balances are to be used before bonus balances for wagers. Stake reserves the right to withdraw any promotion, bonus, or special offer at any time.
Activation & Expiry
12.4 Activating a Bonus or Promotion signifies your agreement to the applicable terms and conditions.
12.5 No promotion, bonus, or special offer will be honored past its expiration date unless otherwise decided by Stake for specific customers or offers. 12.6 Any forfeited or deactivated Bonuses will no longer be available, and any Bonus Funds already credited to your Stake Account Balance will remain accessible.
Bonus Abuse & Fraud
12.7 If Stake suspects that a Player is abusing a bonus or other promotion, or is acting without good faith in exploiting a policy, Stake may deny, withhold, or withdraw any bonus or promotion, or terminate the Player’s access to the Services and/or lock the Player’s account temporarily or permanently.
12.8 Opening multiple accounts for the purpose of accumulating bonuses or promotions is considered abuse and may result in actions as described in 12.7.
Stake Rights
12.9 Stake may remove bonuses from accounts that are inactive or identified as engaging in bonus abuse.
12.10 Stake reserves the right to cancel all unclaimed bonuses within the claiming period or within 60 days, whichever is shorter.
12.11 Stake may at its discretion cancel any bonus.
13. AUTHORITY/TERMS OF SERVICE

AML & SANCTIONS COMPLIANCE

Consequently, the Service is not available to individuals or entities listed on sanctions or watch lists from the United States, European Union, or other international bodies. JURISDICTIONS
14.3 Individuals located in or residents of Afghanistan, Austria, Australia, Belarus, Belgium, Colombia, Côte d’Ivoire, Cuba, Curaçao, Czech Republic, Democratic Republic of the Congo, Denmark, France, Germany, Greece, Iran, Iraq, Israel, Italy, Liberia, Libya, Lithuania, Netherlands, North Korea, Ontario, Pakistan, Portugal, Serbia, Slovakia, South Sudan, Spain, Sudan, Syria, Sweden, Switzerland, United Kingdom, United States, and Zimbabwe (collectively referred to as the “Prohibited Jurisdictions”) are not allowed to use the Service. This restriction applies equally to residents and citizens of other nations while they are located in a Prohibited Jurisdiction. Any efforts to bypass these restrictions, including manipulating information to conceal your location or providing false or misleading information about your residency, constitutes a violation of this Agreement.
14.4 Attempts to disguise your actual location through the use of VPNs, proxies, or similar methods, or by providing inaccurate or deceptive information regarding your residency to evade geo-blocking or jurisdictional restrictions, are considered breaches of Clause 5 of this Terms of Service.
15. YOUR EQUIPMENT
15.1 The performance and operation of the Website may be influenced by your computer equipment, mobile device, and internet connection. Stake does not guarantee that the Website will function without faults or interruptions, nor does it ensure uninterrupted service provision. Stake is not liable for any issues or failures caused by your equipment, internet connection, or telecommunications provider, including difficulties in placing bets, wagers, or accessing event information.
15.2 For customers using mobile devices to place bets or wagers, please be aware that Stake is not responsible for any damage to or data loss from the device on which the software is installed. Stake also does not cover any associated call or data charges incurred while using the software.
15.3 Due to the smaller display sizes on mobile devices, the user experience may vary compared to desktop platforms. Variations may include the placement of information and the visibility of game names on different game pages.
16. FAIR USE
16.1 The Website and Services are intended solely for recreational use, including placing bets and wagers on events and gaming products.

This includes direct, indirect, consequential losses, loss of profit, and reputation damage.
16.5 We reserve the right to refuse, process, or honor bets/wagers that are prohibited or deemed illegal under applicable laws or regulations.
17. SOFTWARE AND TECHNOLOGY ISSUES

17.7 Stake and the Software Provider bear no liability for errors that occur in software or system communications related to account settlement or other software components. Stake may remove affected products and correct errors as necessary.
17.8 Your use of the software is at your own risk, and Stake is not liable for any issues arising from your use or installation of the software.
17.9 The software may contain confidential information crucial to the Software Provider and/or Stake, and you are obligated to maintain that confidentiality in accordance with these Terms and Conditions.

26.1 If any provision of this Agreement becomes illegal, invalid, or unenforceable in any jurisdiction, this will not affect the validity or enforceability of any other provision in that jurisdiction or the validity or enforceability of the affected provision in any other jurisdiction.
27. ASSIGNMENT
27.1 Stake may assign this agreement, in whole or in part, at any time without notice. You may not assign any of your rights or obligations under this Agreement.
28. MISCELLANEOUS
28.1 No waiver by Stake of any breach of this Agreement will be considered as a waiver of any subsequent breach of the same or any other provision.
28.2 This Agreement does not create any rights or benefits for third parties who are not party to it.
28.3 This Agreement does not establish a partnership, agency, trust, fiduciary relationship, or joint venture between you and Stake.
28.4 Stake may assign, transfer, charge, sub-license, or otherwise deal with this Agreement, or subcontract any of its rights and obligations under it, to another party.
28.5 This Agreement represents the complete understanding and agreement between you and Stake concerning the Service and supersedes any prior agreements, understandings, or arrangements.
